While smuggling fireams into Canada might not be illegal in the US, I'm sure BATF could find something to charge the guy with, and any punishment on their side is going to be far worst than what we come up with.

Actually it is a crime. You require an export permit to take any class of firearm out of the US. Not having one is in violation of US law.
